When the time comes, you will use your own Lease, or we can provide you with a copy of one of ours if you choose. HUD requires the Tenancy Addendum be attached to your lease which stipulates that if there are any conflicts between your lease and the HUD’s Tenancy Addendum the Tenancy Addendum overrides. The Housing Assistance Payments Contract is your agreement with MHA. It details your subsidy payment and other benefits and program requirements.
Prior to a new Lease up the property must pass HUD’s Housing Quality Standards (HQS) inspection for being “decent, safe and sanitary” to be approved for the Housing Choice Voucher (HCV) program.
There are additional program requirements including the unit passing the rent reasonableness test. This means landlords cannot charge more rent for the “assisted” unit than they would normally charge in the local private unassisted market.
